The ninth circuit court has maintained a ban on deploying state troops in Portland, Oregon, after a recent legal decision.

Judicial Panel Agrees to Rehear Legal Matter

The federal appeals court decided on Tuesday that it would rehear the legal dispute concerning the executive power with an expanded panel of eleven justices. The judicial body also overturned a earlier ruling from a smaller judicial group that had supported the administration.

Ongoing Dispute Over Troop Deployment

This legal directive represents the latest turn in a long-running court case over whether the administration has the legal right and justification to deploy national guard forces in Portland. Approximately two hundred troops have been in limbo since late September when the deployment effort was started in response to ongoing demonstrations.

Conflicting Arguments

The federal government has claimed that federal officials at the ICE facility in the southern part of the city were facing threats, while local authorities assert that municipal police have control of the circumstances.

Contrary to descriptions of Portland as a conflict zone, locals have been sharing videos of lush hiking trails and a vibrant culinary culture, and organizing events such as an Emergency Naked Bike Ride against the increased military presence.

Court Proceedings

The Tuesday ruling came after a US district judge in Portland issued two temporary restraining orders this period – one blocking the federalization of the Oregon national guard, and another prohibiting the deployment of any military personnel in Oregon, after efforts to evade the first order by mobilizing troops from California.

On the previous day, the appeals court had temporarily suspended the initial decision – permitting control of 200 Oregon national guard – but the subsequent injunction remained in place, blocking the actual deployment of the forces.

En Banc Review

The Tuesday decision means the issue will be heard by the full court – with all decisions under consideration simultaneously – by a group of 11 judges.

“This ruling shows that facts are important and that the judicial system are working to ensure government responsibility. The founding document limits the president’s power, and Oregon’s communities cannot be treated as a testing site for unchecked federal authority,” stated the legal representative in a statement.

“The court is sending a clear message: the president cannot dispatch the military into American urban areas unnecessarily. We will continue protecting Oregon’s laws, principles, and autonomy as this legal proceeding progresses and our legal battle continues in the courts.”
